Obtaining a Certificate of Sponsorship (CoS) to employ a migrant worker is a means of expanding an employer’s options when it comes to recruiting or retaining the best person for the job. A Certificate of Sponsorship is issued by the UK Border Agency for a company to employ a non- EEA national for a specific job and period of time.
Before they can issue Certificates of Sponsorship, an employer needs to first obtain a Sponsorship Licence which will enable them to then sponsor migrant workers. Each time they wish to sponsor a migrant they have to meet the qualifying criteria such as demonstrating that a genuine vacancy exists that cannot be filled by a resident worker. All non-EEA nationals require permission to work in the UK and the employer is duty bound to check this and to maintain suitable records of this permission.
